By having your child attend the Empoli Football Academy you agree to the following agreement between Empoli Football Academy and International Scouting ('The Provider') ABN 92 673 372 257 and yourself ('The Client').

This document is my authority and consent for my child to attend and participate in the activities of Empoli Football Academy and International Scouting. This includes participation in Empoli Football Academy and International Scouting held free days, tournaments, events, matches, training camps, and training clinics. Also, this includes tournaments held at other venues other than Empoli Football Academy and International Scouting home ground.

 

1. I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Empoli Football Academy and International Scouting, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers, volunteers and trustees of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises, of, or for the benefit of, Empoli Football Academy and International Scouting, provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, wilful or wanton misconduct.
    

2. I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Empoli FC, its owner, president, vice president, officers, directors, employees, agents, contractors, sub-contractors, representatives, successors, assigns, and volunteers from and against any and all liabilities, claims, actions, damages, costs, or expenses, demands, debts, contracts, cause of action, lawsuits of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises, of, or for the benefit of, Empoli Football Academy and International Scouting, provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, wilful or wanton misconduct. 
    

3. Whilst due care is taken in carrying out the activities of the Academy, I understand that the activities, in which I will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, I waive all claims of damage, injuries and death sustained to me or my property, that I may have against the aforementioned release party to such activities, including claims in tort, contract, equity or otherwise. Children and their parents or guardians attend and participate in activities of the Academy entirely at their own risk. 
    

4. By this Waiver, I assume any risk, and take full responsibility and waive of personal injury; death, damage, or loss of personal property, associated with Empoli Football Academy and International Scouting, including but not limited to Football training. 
    

5. I acknowledge, agree and represent that I understand the nature of Empoli Football Academy and International Scouting, Children and their parents or guardians attend ARE IN GOOD HEALTH and in PROPER PHYSICAL CONDITION to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will IMMEDIATELY DISCONTINUE further participation in the activity. 

   1. All participants will inform The Provider prior to participation in any activity of the Academy of any medical or other condition  that will or may affect their ability to participate. 

   2. Any participant suffering from any infectious disease or other medical condition cannot attend any activity of The Provider. 

   3. Any participant will inform The Provider prior to participation in any activity of the Academy of any medication they are currently on. “Medication” includes vitamins, supplements and herbal and complementary medicines. 

   4. The Academy may refuse to permit any person to participate for any medical condition or perceived medical condition in its absolute discretion.

   5. The Academy may call an ambulance at its absolute discretion and the parent or guardian will indemnify the Academy in respect of any Claim for any Loss whatsoever arising therefrom, including any costs incurred by the  Academy in relation thereto.

   6. I consent to the administration of first aid by the Academy and indemnify the Academy in respect of any  Claim for any Loss whatsoever arising therefrom.
       

6. Unlawful conduct, bullying (including cyberbullying), unsportsmanlike conduct, and Discriminatory Conduct by any person arising out of or in any way in connection with the activities of the Academy, will not be tolerated. The Academy in its absolute discretion may suspend or cancel participation of any child as a  consequence of such conduct by that child, by their parent or guardian or any other person associated with the child. Parents or guardians who engage in unlawful conduct, bullying (including cyberbullying),  unsportsmanlike conduct, or Discriminatory Conduct arising out of or in any way in connection with the activities of the Academy will not be permitted to attend sessions or otherwise participate in the activities of the Academy.
    

7. Payment is required at the commencement of the term or school holiday camp in accordance with the  Academy Payment Options.
    

8. Refunds are not issued for non-attendance. However, if your child is unable to attend a scheduled session for good cause, the Academy in its absolute discretion may permit your child to attend another session in one of the Academy’s other programs. Make-up attendance in the Academy’s School Holiday  Camps will not be permitted.
    

9. In the event of wet weather, extreme heat or any other good cause requiring the postponement of activities, a WhatsApp message in the Empoli Football Academy Parent Group will be sent advising notice of the postponement of activities. In the event that activities are to be postponed, the Academy will give reasonable notice of the alternative date. Refunds will not be issued for non-attendance on the alternative date.
    

10. All children must wear at sessions the official training gear purchased via the Academy.
     

11. I or another parent or guardian of my child will collect my child at the end of the session or earlier when requested to do so (which request may be by text or voice mail message). I agree that it is not The Provider's responsibility to make sure the child joins the parent or guardian after each program or session.
     

12. The Academy may occasionally take photographs (still and moving) of participants for promotional purposes. Consent is hereby given to the taking and publication of those photographs (still and moving)  and for promotional purposes. 

    1. If you do not wish for your child's image to be used for promotional purposes, you must first notify the Academy in writing. However, no warranty or promise is given to exclude any image of your child from promotional material published.

    2. I agree that no compensation for using any promotional material which includes your child will be given.
        

13. This WAIVER AND RELEASE contain the entire agreement between parties and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties. 
     

14. The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of Empoli Football Academy and International Scouting, whether by agreement, by operation of law, or otherwise. 
     

15. I have read, understood and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by joining the Empoli Football Academy and International Scouting program this WAIVER AND RELEASE I have given up considerable future legal rights. 
     

16. I have agreed to this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My joining Empoli Football Academy and International Scouting program is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law.
